Richard Nixon and His Attitude towards Communism between 1950 and 1960

The main objective of this paper is to confirm, or reject the thesis stating that Richard Nixon had exploited the issue of Communism to favor his political goals. And that he had adjusted his views on Communism according to the contemporary political and social situation. Richard Nixon was a significant Republican politician who had become well known warrior against Communism after the World War II. He, for example, had built his senatorial campaign of 1950 on anti-communist rhetoric attacking his opponent. Strong anti-communist rhetoric was together with his loud criticism of Truman administration a typical characteristic of Nixon. During his vice-presidential office he began to abandon his aggressive tactic. If one considers his later presidential initiative supporting the Sino-American rapprochement, it is worth analyzing whether his anti-communist statements were used in pursuit of his own political goals, or based on an ideology.

This rigorous thesis devotes its attention to the relationship of the Senate and the Government. It describes the areas in which there is co-operation or a conflict, and outlines possible future adjustment of their mutual relations within the constitutional system. In this work it is suggested that even though the Senate does not have (as the Chamber of Deputies does) the opportunity to express confidence or no confidence in the Government, its relationship towards the Government is significant.

Legal guarantees ensuring independent exercise of the parliamentary mandate

This PhD. thesis is dedicated to the legal regulation of instruments presenting guarantees of the independence of the member of parliament during the performance of his/her functions. The aim of this thesis is in particular to present a comprehensive picture of the topic concerning protection of independent performance of the parliamentary mandate, evaluate the Czech legal regulation in force and, last but not the least, to find an answer to the question to what extent is the Czech legal regulation in force complete and effective as well as present possible alternatives de lege ferenda. Member of parliament must be independent with regard to all aspects of the exercise of his/her mandate. Independency of the member of parliament is necessary precondition for his/her ability to exercise the mandate in such a way, which will enable him/her to face external pressures, not only from the state bodies, but also from other subjects or phenomenons. Instruments protecting independent performance of the mandate also support the possibility of members of parliament to fulfil their role freely and as a result to constitute working parliament. Parlamentní imunita je chápána jako nástroj preventivní ochrany, jako institut, který vznikl za účelem ochrany činnosti zákonodárného sboru jako celku. Jeho smyslem je chránit parlament prostřednictvím ochrany jeho jednotlivých členů. Nejedná se tedy o ochranu členů parlamentu jako soukromých osob. Není proto možné chápat imunitu jako osobní privilegium zákonodárců, jako výsadu udělenou v jejich prospěch, ale jako privilegium parlamentu a zprostředkovaně pak i osob, které jej tvoří. Imunita představuje funkční privilegium, je udělena parlamentu a jeho členové jsou chráněni jen proto, že jsou jeho členy. Studie obsahuje historický a teoretický výklad parlamentní imunity, stejně tak jako příklady její úpravy ve vybraných zemích. Zvláštní část práce je věnována popisu platné úpravy v České republice.
